Render opinions on eligibility, validity, and infringement of patents, negotiation of patent licenses, settlement of patent claims, and negotiation of patent clauses in contracts. Provide professional legal advice to contracting officers and procurement personnel on patent matters, the preparation, submission, and/or presentation of applications, briefs, and arguments before the Patent Office or before the Federal Courts. In addition to the foregoing, position may be involved with performing similar professional legal functions regarding trademark and copyright. Expert-level knowledge and experience in evaluating and protecting U.S. Government intellectual property (IP); interpersonal and organizational skills; and the ability to work in fluid environments. Manage the administration, control, and coordination of patent, copyright, trademarks, and data rights in coordination with the current USACE patent attorney. Invention identification and evaluation, patent application filing and prosecution before U.S. and foreign patent offices. Negotiate and resolve IP disputes pertaining to rights of inventors, research collaborators, other agency personnel, private companies, and funding recipients. Help Requirements Conditions of Employment Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation. This position requires the incumbent to submit a Financial Disclosure Statement, OGE-450 (5 CFR 2634, sub-part 1 USOGE, 6/08) upon entering the position and annually. This position requires the incumbent be able to obtain and maintain a determination of eligibility for a Secret security clearance or access for the duration of employment. A background investigation and credit check are required. Must maintain active status, in good standing, with at least one attorney licensing authority. Must provide certification of this status upon appointment and every two years thereafter. Pursuant to EO 14043, all Federal employees, regardless of duty location or work arrangement, must be fully vaccinated for COVID-19 before entrance on duty, subject to exceptions as required by law.
